These Terms of Use ("Terms") govern your use of the Neoboost mobile application ("Application") and any related services, features, or content made available through the Application (collectively the "Service"). By using the Service, you agree to these Terms. If you do not agree to these Terms, you may not use the Service.

Intellectual Property

The Service and all of its content, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio) are the property of us, our licensors, or other providers of such material and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws. You may not use any of these materials without our prior written permission.

User Content

You retain all ownership rights to your User Content. However, by submitting, uploading, or transmitting User Content via the Service, you grant us a non-exclusive, transferable, sub-licensable, royalty-free, worldwide license to use, copy, modify, create derivative works based on, distribute, publicly display, publicly perform, and otherwise exploit in any way your User Content in all formats and distribution channels now known or hereafter devised, but only in connection with the Service, the Company, and on third-party sites and services. We will not disseminate your User Content outside of these limits without your prior consent.

Governing Law

United Kingdom

These terms and conditions shall be governed by and construed in accordance with the laws of England and Wales. Any dispute arising out of or in connection with these terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

European Union

With respect to the law applicable to European Union countries, these Terms and Conditions are subject to the laws and regulations in force in the European Union, including the General Data Protection Regulation (GDPR) with respect to privacy and personal data protection. We are committed to complying with the requirements of the GDPR with respect to the processing of users' personal data. Any claim or dispute arising out of these Terms and Conditions shall be submitted to the competent courts in accordance with the laws in force in the European Union.

United States of America

These Neoboost App Terms and Conditions are governed by the laws of the State of California and are subject to the exclusive jurisdiction of the courts of the State of California for users in the United States of America. By using the App and agreeing to these Terms and Conditions, you consent to the collection, processing, storage, and use of your personal data in accordance with our privacy policy as well as the California Online Privacy Protection Act (CalOPPA) and the U.S. Federal Privacy Protection Act (COPPA).

Nigeria

These Terms of Use shall be governed by and construed in accordance with the laws of the Federal Republic of Nigeria for all users in Nigeria. Any dispute arising out of or in connection with these Terms of Use shall be subject to the exclusive jurisdiction of the Nigerian courts. By using the Neoboost App and its services, you also consent to our processing of your personal data in accordance with the Nigerian Personal Data Protection Act 2019.

Canada

For residents of Canada, these Terms of Use shall be governed by and construed in accordance with the laws in force in the Province of Quebec, Canada, without regard to conflict of laws principles. Any dispute arising out of these Terms or your use of the Service shall be submitted to the courts of the Province of Quebec, and you consent to the exclusive jurisdiction of those courts to settle all disputes. The United Nations Convention on Contracts for the International Sale of Goods does not apply to these Terms.

India

For users residing in India, these Terms of Use shall be governed by and construed in accordance with the laws of India without regard to its conflict of law provisions. Any dispute arising out of or relating to these terms shall be subject to the exclusive jurisdiction of the courts of New Delhi, India. Users agree to submit to the personal and exclusive jurisdiction of the courts in New Delhi for any claim or cause of action arising out of these Terms or their use of the Service.

Pakistan

For users located in Pakistan, these Terms of Service shall be governed by and construed in accordance with the laws of the Islamic Republic of Pakistan. Any dispute arising out of or relating to these Terms of Use shall be subject to the exclusive jurisdiction of the Pakistani courts.

Morocco

Residents of Morocco are subject to the laws in force in the country with regard to the conditions of use. Disputes arising out of these terms or use of the application will be handled exclusively by Moroccan courts. You agree to submit to the exclusive jurisdiction of these courts to resolve any dispute. Moroccan law shall prevail over any foreign law in the event of a conflict with these terms.

Algeria

As far as Algerian law is concerned, these General Terms and Conditions of Sale are governed by the laws and regulations in force in Algeria, including all provisions relating to the protection of privacy and personal data. We undertake to comply fully with the requirements for the protection of personal data in accordance with the laws applicable in Algeria. Any dispute or claim arising from these General Terms and Conditions of Sale shall be submitted to the competent courts in accordance with the laws in force in Algeria.

United Arab Emirates (UAE)

For users accessing the Service within the United Arab Emirates, these Terms of Use are subject to the laws and regulatory framework established by the United Arab Emirates. By using the Service, you agree to comply with all local laws and regulations applicable in the UAE, including but not limited to those concerning online conduct, acceptable content, and the protection of personal data.
